Games Terms of Use
Last updated 2 November 2026
These terms are an agreement between you and Heavy Collectables (“we”, “us”) for the games we publish (each a “Game”). By installing, opening or playing a Game you accept these terms, its Privacy Policy and every notice shown in it. If you don’t agree, don’t play.
1. What our Games are
Our Games are works of entertainment. Everything in them, including cards, packs, characters, names and artwork, is fictional and made by us or licensed to us. Nothing in a Game is a real trading card, and no in-game item has any value outside the Game.
Our Games are not affiliated with, endorsed by or connected to any trading card company, card game or grading company. Any resemblance to a real product is coincidental, and real-world trademarks belong to their owners.
2. Age and ratings
Each Game carries the age rating shown on its store listing, and you must meet it. In Australia, games that sell packs or items with random contents for real money are classified M (recommended for mature audiences, 15 and over), and games with gambling-like elements are classified R 18+. If you are under 18, you may only play with the permission of a parent or guardian, who accepts these terms for you and is responsible for your play and any purchases made on your account.
3. Purchases
Some Games sell virtual items, currency or packs for real money. Purchases are made through the app store (such as Google Play), under the store’s own terms, prices and payment methods. A purchase buys a limited, personal, non-transferable licence to use that item inside the Game. You do not own it, it cannot be exchanged for money or anything outside the Game, and it cannot be transferred or sold to anyone else.
Prices are shown in the store before you buy and include any applicable tax. We may change prices, items and what is offered at any time; changes don’t affect purchases already made.
4. Packs and random items
Some items come in packs whose contents are random. Before you buy a pack, the Game shows the odds of each rarity. Odds describe the chance for each pack; they do not promise any particular result, and buying more packs does not guarantee any particular card. Random contents are decided inside the Game when the pack is opened, and we don’t adjust them for individual players.
There is no way to cash out, trade or sell items for money inside a Game, and nothing in a Game is gambling. Please set a budget before you buy and keep to it.
5. Refunds
Because purchases are made through the app store, refunds are handled by the store under its policy and the Australian Consumer Law. If something you paid for didn’t work or wasn’t delivered, contact us and we will help put it right. Changing your mind, opening a pack and not liking its contents, or losing progress because your device or its data was reset are not faults in the Game.
6. Your progress and data
Our Games play offline and save your progress, collection and purchases on your device. If you uninstall a Game, clear its data, lose or reset your device, that progress may be lost and we may not be able to restore it. Where a Game offers a backup through the app store or your device’s own service, use it; it is covered by that service’s terms.
7. Fair play
You must not cheat, modify, hack or reverse engineer a Game, use tools to alter its data or outcomes, bypass purchases, or copy or redistribute it. If you do, we may remove items, reset progress or stop you playing, and you aren’t entitled to a refund for what you lose.
8. Intellectual property
Each Game, including its software, cards, artwork, names, text and design, belongs to Heavy Collectables or its licensors. You may play it for your own personal, non-commercial use. You may share screenshots and videos of your play, including on streaming platforms, as long as you don’t claim the Game as your own, present it as official content of any other company, or use it to mislead anyone.
9. Feedback
If you send us ideas, suggestions or feedback, we may use them freely, without payment or credit to you, and you give up any claim to them.
10. Australian Consumer Law
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded. Where a guarantee cannot be excluded but our liability for breaching it can be limited, our liability is limited, at our option, to supplying the Game or item again or paying the cost of having it supplied again.
11. Limits on our liability
Subject to section 10, our Games are provided “as is” and “as available”, without warranties of any kind. To the maximum extent the law allows, Heavy Collectables and its officers, employees and contractors are not liable for any loss or damage arising from or connected with a Game, including lost progress, lost items, lost data, device problems or disappointment with random contents, whether in contract, tort (including negligence), statute or otherwise. Where liability cannot be excluded, our total liability is limited to the amount you paid us for the Game in the twelve months before the claim.
12. Your responsibility to us
You agree to compensate Heavy Collectables for any loss, cost or claim that arises from your breach of these terms or your misuse of a Game.
13. Ending your access
We may stop you playing a Game, or any part of it, if we reasonably believe you have broken these terms. You may stop at any time by uninstalling it. Sections 1, 3, 8, 9, 11, 12 and 15 to 18 continue to apply after your access ends.
14. Changes and availability
We may change, update, suspend or stop a Game, or any feature, item or offer in it, at any time without notice or liability, including removing a Game from sale. We may change these terms; the Game will ask you to accept the new version before you continue, and continued play after that is acceptance.
15. Sorting out problems
If you have a complaint or a dispute with us, email us first with the details and give us 30 days to resolve it before starting any court or tribunal action. Nothing in this section stops you making a complaint to a consumer protection agency or seeking urgent relief from a court where the law allows it.
16. Transfer
We may transfer a Game, these terms and our rights and obligations under them to another person or company, for example if Heavy Collectables changes its business structure or is sold, and the new owner then stands in our place. You may not transfer your rights, account or items to anyone else.
17. Things outside our control
We are not responsible for any failure or delay caused by something outside our reasonable control, including faults in your device or operating system, app store outages, payment provider problems, loss of your data, changes in the law, or events such as natural disasters.
18. General
These terms are governed by the laws of Queensland, Australia, and you agree to the non-exclusive jurisdiction of its courts. If any part of these terms is unenforceable, that part is read down or removed and the rest still applies. If we don’t enforce a right on one occasion, we can still enforce it later. These terms, with the Game’s Privacy Policy and the notices shown in it, are the whole agreement between you and us about the Game.
